TERMS AND CONDITIONS - International Contest in Dress Reconstruction and for Dress Designers
General Provisions
  1. Terms and Conditions determine conditions of Helena Modjeska – icon of style contest which aims at discovery and promotion of young, talented individuals, with passion for the fashion of the second half of the 19th century.

Terms of participation
  1. The organizer welcomes participation in the contest by pupils, students and graduates of cloth design and art schools, who are under the age of 30, and also by all those with a passion for clothes design and recreation of historical dresses.
Contest categories
  1. Contest will be held and results announced in two categories:
    • 6.1 Reconstructions (A) – sewing a replica of stage or private dress of Helena Modjeska.
    • 6.2 Inspirations ( Prêt-à-porter) (B) – creating own design, inspired by stage or private clothes of the actress (Prêt-à-porter – ready to wear).
  2. Only designs by individuals can be submitted. The organizer does not foresee a possibility of collective work submissions.
  3. Works that previously took part in other contests, received awards or/and were published – are excluded from participation in the contest.
Stages of the contest
  1. The contest in each category will be held in three stages:
    I stage - applications
    9.1.For Reconstructions category (A) – participants select one dress for reconstruction on the website of the contest, reserve it, fill in the application form and then print it out. Selection and reservation of dresses is located at Modjeska/Description of dresses and patterns/ web page. Participants do not need to make a fashion magazine style drawing. They only reserve one dress.
    9.2. For Reconstructions category (A) – participants submit in a paper file, signed with name and surname; application form alongside documentation containing description of accessories and type of fabric and attached sample of fabric of which reconstructed dress will be made.
    9.3. For Inspirations (Prêt-à-porter) category (B) – participants do not reserve dresses. They make their own designs based on selected dresses presented in Photo gallery under Modjeska section. They fill in the application form at the bottom of Photo gallery page and select dresses. Then they print out the application form. A minimum of 2 (two) and maximum of 5 (five) color, A4 format, drawings in a fashion magazine style should be forwarded/submitted.
    9.4. For Inspirations (Prêt-à-porter) category (B) – participants submit in a paper file, signed with name and surname; application form alongside description containing assumptions, description of style, accessories, kind and color of fabrics and presenting source of inspiration. They should also attach designs as fashion magazine style drawings and also samples of fabrics of which dress will be made.
    9.5. Deadline for submitting applications is April 30th 2012(determined by postmark). Works submitted after the deadline or failing to fulfill conditions outlined in the Terms and Conditions will not qualify for participation in the contest.

    9.7.List of participant who qualified to take part in the stage two of the contest will be posted until May 15th 2012 on the website of the contest at: www.konkursmoda.wilanow-palac.pl.
    9.8. All participants who qualify, will be noted via email or phone call that they have qualified to the second stage of the contest.
    9.9. All participants – regardless of selected category – fill in the application form posted on the website of the contest.
    9.10. Filling in the application form is identical with declaring that the person named in it:
    • is the author of submitted designs,
    • will author the actual clothes,
    • models on the photographs, dressed in clothes designed and made by the author, agree to those photographs being, among other, distributed with the aim of promoting and advertising the contest,
    • authors of photographs undertake not to make any claims against the Wilanów Palace Museum resulting from copyright law and agree for the organizer of the contest to use those photos in all fields named in copyright law and related laws and regulations without any limitations and in particular to:
      • record on any storage medium;
      • multiply by any technical means;
      • place on the market;
      • input to and store in computer memory;
      • publicly play, exhibit, display by any means;
      • broadcast and rebroadcast as audio or video;
      • use photos for promoting products produced by the organizer or on his order regardless of whether the photos were used in those products;
      • use photos for promoting organizer and his activities;
      • hare on the Internet and on other computer networks (making photos publicly available in a way that anyone could have access to them in place and time of their choice);
      • right to exploit photos in all the above named fields refers as well to the right of exploiting them in connection with works of other authors in any kind of publications, in original form or after processing, in whole or in part;
    • authors are fully liable legally and materially for infringement of rights including copyright of third parties and in case of resulting claims against the Wilanów Palace Museum they undertake to release the Wilanów Palace Museum from any resulting liability and from satisfying legitimate claims by third partie,
    • authors accept Terms and Conditions of the contest and agree that their personal data will be processed in accordance with the Personnel Protection Act of 29.08.1997 (unitary text: Dz.U. from 2002. number 101, pos. 926 with latter amendments). if such a data will be revealed during contest and in connection to its course. According to paragraph 24 of the above Act, the organizer informs participants that their personal data will be stored and processed based on free will consent given by the participant, solely in the seat of the Organizer, exclusively in accordance with carrying out those Terms and Conditions and for the purpose of forwarding to the participants advertising materials, information about another activities and contests. Each participant has a right to view and correct their respective personal data;
    • Minors may participate in the contest provided their legal custodians consent to their participation in accordance with these Terms and Conditions.
    2nd stage
    9.11.All participants who qualify to the 2nd stage, should forward or deliver personally their contest works on hanger, in dress bag, signed with their name and surname between November 5th and November 9th 2012.
    9.12. Participants who qualify to the 2nd stage of the Contest in Inspirations Prêt-à-porter category (B) will forward the work selected by the Jury from among designs submitted during stage one of the contest.

    3rd stage – results of the Contest
    9.14. Results of the contest will be decided in March 2013
    9.15. Information on results including names of winners will be posted on the website of the Wilanów Palace Museum untilApril 15th 2013
Time and place of Final Gala
  1. Opening of exhibition showcasing contest designs and awards ceremony during which results of the contest will be announced will be held in the Wilanów Palace Museum, Stanisława Kostki Potockiego str.10/16, Warsaw, Poland and are scheduled for May 2013. The organizer reserves the right to change the date of awards ceremony.
Jury of the Contest
  1. The organizer appoints the jury made up of people dealing with fashion, and having experience both in the field of historical dress reconstruction and cloth design and of dress historians and dress designers.
  2. Jury works in secrecy and its decisions are final and are not subject to appeal.
Evaluation criteria
  1. All the works submitted to the Contest must meet the following requirements:
    size 38, bust 90, waist 68 (70), hips 90, height 170-175 cm.
    13.1Evaluation criteria for Reconstructions category (A):
    • a. Faithfulness of created dress to selected model.
    • b. Style:
         –historical style,
         – appropriate composition of individual dress items,
         –proper proportions (length, fitting the figure, size of collar, cuffs etc.),
         –technology of production.
    • c. Fabric and its agreement with the era:
         –properly selected kind of fabric in accordance with selected Helena Modjeska dress, and also most similar to those used in the 19th century,
         –pattern as close to the original as possible,
         –color palette in agreement with the era (decade from which dress is).
    • d. Finishing items (ribbons, trimmings, lace, etc.):
         –properly fitting with selected type of dress.
    • e. Accessories (lingerie: corset, pantaloons, petticoats, frames, as well as headgear, shoes and other items of clothing):
         – fashion in accordance with the era,
         –used materials,
         –craftsmanship.
    • f. Aesthetic appeal and compatibility with a taste of its era.
    • g. The amount of work put into making of clothing:
         –elaboration of style,
         – precision of make and finishing;
    13.2Evaluation criteria for Inspirations category (Prêt-à-porter) (B):
    • a. Utility.
    • b. Choice of fabrics, colors and accessories.
    • c. Craftsmanship.
    • d. Appropriateness for the topic of the contest, clear reference to selected original.
    • e. Originality.
Awards and prizes
  1. Jury of the Contest awards money prizes in both categories:
    14.1 Reconstructions category (A):
    • 1st place – money prize of 6000 zlotys
    • 2nd place – money prize of 4000 zlotys
    • 3rd place – money prize of 2000 zlotys
    • Winners of first, second and third place prizes will also receive possibility to showcase their works personally during Helena Modjeska themed exhibition in California, US.
    14.2 Inspirations category (B):
    • 1st place – money prize of 3500 zlotys
    • 2nd place – money prize of 2500 zlotys
    • 3rd place - money prize of 1500 zlotys
    14.3Organizer reserves the right to showcase awarded works on exhibitions domestically and abroad.
    14.4.Winners of the contest in Reconstructions category (places 1,2,3) will transfer all property and ownership rights to their works submitted to the contest to the organizer.
    14.5. Accordingly, the organizer reserves the right to transfer contest designs in Reconstructions category (places 1,2,3) to Helena Modjeska Society so that in the future they could become part of permanent exhibition in Helena Modjeska Museum in California.
    14.6. Authors of all the awarded works receive prizes funded by the organizer and sponsors.
    14.7. Promoters of awarded works will receive congratulatory letter.
    14.8. Authors of designs and dresses receiving awards and prizes will grant the Wilanów Palace Museum, free of charge, unrestricted in time, right to use their designs in educational and cultural activities of the Museum, provided author is named.
    14.9. Results of the contest – names of winners and authors of awarded works will be posted on the website of the Wilanów Palace Museum and published in exhibition’s brochure.
    14.10. The organizer reserves the right to award special and additional prizes or honors, or not to grant awards if presented clothes do not fill the conditions of the contest.
    14.11. The Wilanów Palace Museum may cancel the contest if participants are not qualified or if too few entries would be submitted.
    14.12. All the works which took part in the contest except for those that receive 1,2,3 prizes in Reconstructions category (A) may be picked up after the closing of post-contest exhibitions. Costs of packaging and delivery to respective authors seats are fully borne by authors. Works not picked up within 14 days after closing post-contest exhibitions will become exclusive property of the Wilanów Palace Museum. In such a case copyright, without any territorial restrictions and for the whole time when valid, on all possible fields where it could be used, will pass to the Wilanów Palace Museum. The organizer will notify authors via email or phone regarding closing date of exhibitions.
Final provisions
  1. The organizer makes it clear that it is not liable for events that could prevent proper execution of the contest and which could not be foreseen or prevented, in particular in case of random events including force majeure.
  2. The organizer reserves the right to change provisions of these Terms and Conditions in case of change in legal regulations or other important events having impact on organization of the contest.
  3. The provisions of these Terms and Conditions are a sole basis for conducting the contest and their interpretation is exclusively up to organizer of the contest.
  4. All the issues not regulated by these Terms and Conditions and concerning the Contest will be decided by the Organizer. Participants in the contest besides possibly prizes awarded in accordance with paragraph 13 are not entitled to any form of remuneration.
  5. The Contest is not subject to the provisions of the Games and Reciprocal Bets Act of 29.07.1992 (published in DZ. U. number 4 from 2004 position 27 including amendments).
  6. Above Terms and Conditions come into force at the day of Contest’s launch and remain in force until its closing.
